Curious Path to Statewide Moratorium on Evictions - "State of the Judiciary"

The Judicial Council of California is the rule-making arm of the judiciary of California

The "State of the Judiciary Address" has been given to the California Legislative branches since 2012 when then Chief Justice Chief Justice Tani G. Cantil-Sakauye gave her inaugural address and "described to a joint session of the state Legislature the “fresh approach to the governance” of the judicial branch that she has taken during her first year in office" First State of the Judiciary Address to Legislature (ca.gov)        Address:  State of the Judiciary March 2012 (ca.gov)

There is nothing in the Constitution of California mandating the Judicial Branch report to the Legislative Branch, nor are there any parameters for the details of such non-existent mandate.

"The Governor issued emergency orders, executive orders—and he gave us one, unprecedented, giving the Judicial Council, the Chief Justice, and chair of the Judicial Council the unprecedented authority to protect the public and our courthouses.

We used this authority very carefully. One of the first things we did was to initiate a statewide halt on all evictions. And we did so for several reasons, including that we as a court needed to shrink our in-person footprint so as not to become a superspreader. But we also couldn’t see evicting people during a time of shelter-in-place orders while some people were losing their incomes. Eviction is more than just being moved, it’s a life changing event."
