  •  AB 586 (Flora) Professional fiduciaries
    • SECTION 1.
      Section 6501 of the Business and Professions Code is amended to read:
    • 6501.As used in this chapter, the following terms have the following meanings:
    • (f) (1) “Professional fiduciary” means any of the following:
      • (A) A person who acts as a guardian or conservator of the person, the estate, or the person and estate, for two or more individuals at the same time who are not related to the professional fiduciary or to each other.
      • (B) A personal representative of a decedent’s estate, as defined in Section 58 of the Probate Code, for two or more individuals at the same time who are not related to the professional fiduciary or to each other.
      • (C) A person who acts as a trustee, agent under a durable power of attorney for health care, or agent under a durable power of attorney for finances, for more than three individuals, at the same time.
      • (D) A professional fiduciary professional corporation authorized to render professional services, as defined in Section 13401 of the Corporations Code, and in compliance with Article 7 (commencing with Section 6593).
    • Existing law generally regulates probate, guardianship, conservatorship, and other protective proceedings. Existing law defines “professional fiduciary” for these purposes. Existing law prohibits a person from holding themselves out to the public as a professional fiduciary unless they are licensed pursuant to the Professional Fiduciaries Act.
    • This bill would include a professional fiduciary professional corporation, described above, in that definition of “professional fiduciary.” The bill would remove the provision prohibiting a person from holding themselves out to the public as a professional fiduciary unless they are licensed pursuant to the Professional Fiduciaries Act.
    • Existing law prohibits a superior court from appointing a person to carry out the duties of a professional fiduciary unless that person holds a valid, unexpired, and unsuspended license as a professional fiduciary or is exempt from those licensing requirements, as specified.
    • The bill would recast repeal those provisions to and would instead prohibit a superior court from appointing a professional fiduciary to specified positions as, or permitting a professional fiduciary to continue as, a guardian, conservator, personal representative, or trustee, unless the professional fiduciary satisfies one of specified requirements.
  • Bill Text - AB-1105 Conservatorships. (currently in Senate Judiciary committee)
    • Existing law, the Guardianship-Conservatorship Law, generally establishes the standards and procedures for the appointment and termination of an appointment for a guardian or conservator of a person, an estate, or both. Existing law authorizes a conservator to authorize the placement of a conservatee in a secured perimeter residential care facility for the elderly upon a court making specific findings.
    • This bill would also authorize a conservator to authorize the placement of a conservatee in a residential facility, an intermediate care facility, or a skilled nursing facility, as defined, that has a secured perimeter, a delayed egress, egress lock, or both a secured perimeter and a delayed egress. egress lock, as specified. The bill would require court approval for a subsequent placement that seeks to move of a conservatee to in a different type of facility except if the change occurs as a result of an emergency. The bill would require the State Department of Social Services and the State Department of Public Health to update regulations related to these provisions by January 1, 2027, and would authorize those departments to promulgate emergency regulations prior to that date.
