The U.S. Postal Service Law Dept. has 200 attorneys providing their in-house legal representation, INCLUDING ELECTION MAIL. Their mission statement was adopted April 1, 2020.

There are ten directives, practice groups, of the USPS legal department; an example, beyond those that deal with employees include:

  • The Procurement and Property Law attorneys help the Postal Service acquire the property, goods, and services necessary to fulfill its universal service mission.
  • The Corporate and Postal Business Law Section of the Law Department supports the efforts of the Board of Governors, the Postmaster General, the Executive Leadership Team as a whole, and a host of other internal stakeholders, to legally advance the governmental and commercial interests of the Postal Service, both domestically and internationally.
  • The Legal Strategy team consists of the Commercial and Appellate Litigation Group and the Legal Policy and Legislative Advice Group. ppolicy attorneys are responsible for advice ON
    • legislation (including technical assistance on bills related to the Postal Service)
    • strategically significant dockets before the Postal Regulatory Commission, 
    • issues involving other Executive Branch agencies
    • applicability of laws and directives to the Postal Service
    • constitutional questions (including First Amendment issues and conduct on Postal Property)

The United States Postal Service is an independent establishment of the executive branch (effective 1970) originally established in 1775.

  • Postal Reorganization Act (PRA) of 1970 - signed By President Nixon 
    •  The law transformed the Cabinet-level Post Office Department into an independent establishment of the Executive Branch
    • Leadership structure like that of a private corporation
      • free of direct political control
      • significant authority over rates, operations, and employment.
  • Postal Accountability and Enhancement Act - signed by President Bush
    • Required the Postal Service to accelerate the prefunding of 100 percent of our expected retiree health benefits obligations
    • Imposed a rigid price cap on most services for at least 10 years
    • Prohibited offering new products and services beyond core shipping and mailing services.
  • Postal Service Reform Act (PSRA) of 2022 - signed by President Bident
    • Repealed the requirement that the Postal Service annually prepay all future retiree health benefits
    • Canceled all past due prefunding obligations
    • Mandated retiree health benefit integration with Medicare
    • Did not modify the Postal Service’s requirement to be self-funded as an independent entity that receives zero tax-payer dollars for operational expenses.
