Reports on the current trial of Rebecca Grossman trial for the 9/29/2020 death of two children, by what is now asserted as the driver of another car, highlight the value of due process.
According to CourtHouse News: The defense attorney for Rebecca Grossman, Tony Buzbee, told the jury:
“The police are prosecuting the wrong person...Mr. Erickson stopped his vehicle, he hid in the bushes, watching what the police were doing. He went to Mr. Grossman’s house and said some very inflammatory things, and then went home.”
The defense attorney said that Erickson, who in security videos appears to be going faster than Grossman, hit both boys with his car, and that Grossman, seconds behind, hit the children as well.
"Two cars, or perhaps three, hit those little boys," said Buzbee.
If it proves the assertions, from the defense team for Rebecca Grossman, are true then additional investigations should be forthcoming OF the process. Specifically:
- Erickson's black Mercedes was apparently never looked at by law enforcement.
- Erickson hid in the bushes, watching what the police were doing.
- Erickson told investigators he was driving a different, older black Mercedes SUV that he still owns YET Erickson...
- Was charged with reckless driving in the incident.
- Agreed to participate in a public service announcement about safe driving in lieu of jail time.
- "Two cars, or perhaps three, hit those little boys," said Buzbee.
- A video from a house overlooking Triunfo Canyon Road a short distance from the crash site shows several cars passing in the moments after impact.
The British newspaper DailyMail has revealed the case has received national attention. Perhaps because attorney Buzbee is challenging the reliability of
- Sobriety field tests
- Automotive "black boxes," which capture data prior to a crash.
It should be noted the Iskander family has withdrawn their suit against the City of Westlake for dangerous street conditions at the intersection. However, it has been reported the defense intends to point out the bad road design.
Initial reports detail the order the family crossed the street 9/29/20. "Nancy Iskander said she arrived at the crosswalk where Saddle Mountain Drive meets Triunfo with her three boys in tow. A conviction of second-degree murder (which many social media pundits have adamantly proclaimed the situation calls for this verdict) requires the prosecution proves the defendant acted with implied malice — that they knew what they were doing.
