Residency Requirements of Legislators

Municipal & State & Federal residency requirements vary both in length of residency and location for legislators desiring to represent the constituents of a district.

  • Must live in the district At least 30 days prior to the first day to file for candidacy 
  • U.S. Citizen
  • 18 yrs of age 

Los Angeles State Assembly & Senate candidates must meet the Qualifications for Running for Office in 2022 :: California Secretary of State 

  • Live in the district (qualified to vote for the office being
    • Be otherwise qualified to vote for the office if the person was a resident of, and
      registered to vote in, the election district from which the office is elected.
  • Be residents for a year, of the district they desire to represent. - this is being contested
  • The age requirement is based on voting age.

CHAPTER 6.3. County of Los Angeles Citizens Redistricting Commission [21530 - 21535]

U.S. Congressional candidates, according to  U.S. Constitution, Article I, section 2, clause 2 must 

  • Live in the state
  • Be a citizen of the country for at least seven years
  • Be a resident of the state on the date they take their oath.
  • Be twenty-five years of age 

The Constitution doesn't even require the speaker—to be a member.

U.S. Senate candidates must, according to U.S. Constitution Article I, section 3, clause 3

  • Should live in the state
  • Be a citizen of the country for at least nine years
  • Be thirty years of age

The districts are changed every 10 years, based upon the census. The maps are finalized before the election but this year that date was moved out to December of 2021 because of Covid shutdowns.  The contentious redistricting discussions of the Los Angeles City Council maps, which were clandestinely recorded, is proof how much attention is paid to the maps by current office holders.  

That attention to the Congressional maps drew attention in California because it is the first time the population had decreased after a census, causing the state to lose one district. The end result was a revelation how much the new districts had a more even distribution of the population demographics. 


 Ironically because of the new maps the Congressman for the West San Fernando Valley was no longer in the district he had represented for the prior 10 years.  The 30th Congressional district essentially became the 32nd.  Congressman Brad Sherman put his home on the market in March 2022, even the law does not require he live in the district. The home is located above the 118 freeway, which would have put him in the 27th Congressional (won by Mike Garcia).  Congressman Sherman has represented most of the West Valley, and the corridor along the 101 freeway to the southern border of Mulholland for nearly 22 years.  He listed his home in March of this year at $1,750,000 (a 149% increase from the last listed price sold in 2002 at $747k). It eventually sold in August 2022 for $1,470,000 a 100% increase from the 2002 price.
