The incumbent, Tony Cardenas, announced on 11/20/23 he is not running for re-election.

According to Article I, Section 2 of the U.S. Constitution, House members must be:

  • at least 25 years of age;
  • a citizen of the United States for at least seven years prior to being elected;
  • a resident of the state he or she is chosen to represent.*

* Residency has become an issue in many Congressional races, especially after redistricting as a result of the census. It is this anomaly which occurs in states with great population fluctuations, such as California which lost a district after the 2020 census! An incumbent's residence could no longer be in the district (this happened to the current 32nd district Congressman of Porter Ranch after the 2020 census) he/she represents, leaving the option to change districts or to run as an outsider.

However, the courts have ruled this "a resident of the state..." means at the time of the election....and other commentaries suggest on the day they take their oath !!

"While Article I, Section 2, Clause 2 expressly requires state inhabitancy at the time of the election, Congress has interpreted the House Qualifications Clause to require only that Members meet age and citizenship qualifications at the time they take the oath of office.6 Thus, Congress has admitted persons, who were ineligible when elected, to the House of Representatives once they met age and citizenship criteria for membership in the House.7 Further, the Supreme Court held in Powell v. McCormack8 and U.S. Term Limits, Inc. v. Thornton9 that neither Congress nor the states, respectively, can add to the qualifications stipulated in the Constitution for membership in Congress."
